Vandam Capital Group LLC (“Vandam Capital Group,” “we,” “us,” or “our”) respects the privacy of the businesses and individuals who use vandamcapitalgroup.com (the “Site”) and who apply for business funding through us. This policy explains what we collect, how we use it, who we share it with, and the choices you have.

Our services are directed to businesses and their authorized representatives, not to consumers seeking personal, family, or household credit, and not to children under 18.

1. Information we collect

Information you give us

  • Business information — legal business name, entity type, address, state, industry, time in business, revenue, existing financing obligations, and use of funds.
  • Contact information — your name, title, business email address, and phone number.
  • Financial documents — business bank statements, financial statements, tax returns, invoices, voided checks, and copies of existing funding agreements that you submit.
  • Identity information — government-issued identification for owners or authorized signers where required to verify identity or comply with law.
  • Communications — the content of emails, form submissions, text messages, and call notes.

Information we obtain from others

  • Business and personal credit reports from consumer and commercial reporting agencies, which you authorize when you submit an application.
  • Public records, including UCC filings, business registrations, liens, and judgments.
  • Bank account and transaction verification data from you or from bank-verification service providers you authorize.
  • Information from referral partners, brokers, or independent sales organizations that submit your request to us.

Information collected automatically

  • Standard server and log data such as IP address, browser type, device type, referring page, and pages viewed.
  • Cookies and similar technologies used to operate the Site, remember preferences, and measure traffic. You can control cookies through your browser settings; some Site features may not work without them.

2. How we use information

  • To evaluate, underwrite, price, and decision your funding request.
  • To verify your identity, your business, and the accuracy of what you submit.
  • To communicate with you about your application, offers, and any funded transaction, including by phone, email, and (with your consent) text message.
  • To service, collect, and administer any funding we provide.
  • To detect and prevent fraud and to protect the security of our systems.
  • To comply with applicable law, including state commercial financing disclosure and licensing requirements, anti-money-laundering rules, and lawful requests from authorities.
  • To improve our services and, where permitted, to send you information about products we think may be relevant to your business.

3. How we share information

We do not sell your application data to lead-generation buyers. We share information only as follows:

  • Funding sources and partners. If we do not fund a request directly, or if a partner is better suited to it, we may submit your information to one or more third-party funders, syndicators, or participants for review. We may receive compensation in connection with a funded transaction.
  • Service providers. Underwriting, bank-verification, e-signature, payment processing, hosting, email, CRM, and analytics providers who act on our behalf.
  • Credit reporting and verification agencies, as authorized by you.
  • Professional advisors such as attorneys, accountants, and auditors.
  • Legal and safety. Where required by law, subpoena, or court order, or to establish or defend legal claims, prevent fraud, or protect the rights and safety of any person.
  • Business transfers. In connection with a merger, financing, acquisition, or sale of all or part of our business or assets.

4. Text message (SMS) terms and consent

Providing a mobile number and checking the SMS consent box on our forms means you agree to receive recurring text messages from Vandam Capital Group at that number regarding your application, funding offers, document requests, and account servicing.

  • Consent is optional. Agreeing to receive text messages is not a condition of applying for, purchasing, or receiving any funding or service.
  • Message frequency varies based on your application activity and account status.
  • Message and data rates may apply from your mobile carrier.
  • To opt out, reply STOP to any message. You will receive a single confirmation and no further messages, other than any message required to complete a transaction you initiated.

  • Carriers are not liable for delayed or undelivered messages.
  • We do not share mobile numbers or SMS consent with third parties or affiliates for their own marketing purposes. Mobile information collected for SMS is used only to deliver the messages you consented to, and is shared only with the messaging service providers that transmit them on our behalf.

Separately, by submitting a form on this Site you consent to be contacted by Vandam Capital Group at the phone number and email address you provide, including by automatic telephone dialing system or prerecorded voice, about your funding request. This consent is not a condition of any purchase, and you may revoke it at any time by contacting us at phil@vandamcapitalgroup.com.

5. Data retention

We keep application and transaction records for as long as needed to service the relationship and to satisfy legal, tax, audit, and recordkeeping obligations, after which we delete or de-identify them.

6. Security

We use administrative, technical, and physical safeguards designed to protect the information you submit, including encryption in transit. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please do not send sensitive documents to us over unsecured channels if you are not comfortable doing so.

7. Your choices and rights

  • Email. You may unsubscribe from marketing email using the link in any message. We will still send messages necessary to service an active application or funded transaction.
  • Text messages. Reply STOP at any time, as described above.
  • Calls. Tell us to stop calling and we will honor the request.
  • Access, correction, and deletion. Depending on where you are located and the capacity in which you dealt with us, you may have rights to request access to, correction of, or deletion of personal information we hold. Contact us at phil@vandamcapitalgroup.com and we will respond as required by applicable law. We may need to verify your identity and authority before acting.

Note that much of the information we process relates to businesses rather than to individuals acting in a personal capacity, and some privacy laws apply differently in that context.

8. Third-party sites

The Site may link to third-party websites. We are not responsible for their content or their privacy practices, and this policy does not apply to them.

9. Changes to this policy

We may update this policy from time to time. The “last updated” date above reflects the most recent version. Material changes will be posted on this page.
